While employer-mandated vaccines are lawful, Title VII prohibits employers from discriminating against employees on the basis of race, color, religion, sex, and national origin. As it relates to workplace mandated vaccines, the EEOC provides that employers must provide a reasonable accommodation to employees who do not get vaccinated for COVID-19 due to a sincerely held religious belief, unless providing such accommodation would pose an undue hardship on the employer. Under Title VII, courts define undue hardship as having more than minimal cost or burden on the employer. Considerations relevant to this determination include, among other things, the proportion of employees in the workplace who already are partially or fully vaccinated against COVID-19 and the extent of employee contact with non-employees, whose vaccination status could be unknown or who may be ineligible for the vaccine.

Protections Under The Equal Employment Opportunity Commission

The Equal Employment Opportunity Commission enforces anti-discrimination laws in the workplace. These laws include the Rehabilitation Act and the Americans with Disabilities Act, which prohibit discrimination based on disability and require employers to provide reasonable accommodations for employees with disabilities.

Throughout the COVID-19 pandemic, the EEO laws apply. However, these laws do not prevent employers from adhering to the guidelines made by state and local public health authorities and the CDC. Since public health guidance has changed as the pandemic has evolved, employers should continue following the current information for maintaining safety in the workplace.

What About Pregnant Or Breastfeeding Employees

In April 2021, the Joint Committee on Vaccination and Immunisation issued a press release for pregnant women advising that pregnant women should be offered the vaccine at the same time as the rest of the population, based on their age and clinical risk group.

The Government does not consider COVID-19 vaccines a risk to the breastfeeding infant and the JCVI has recommended that breastfeeding women can receive the vaccine. This is in line with recommendations in the US and from the World Health Organisation.

Despite this guidance, it is likely that some pregnant employees will have concerns about receiving the vaccine and employers should therefore proceed with caution. Employers should continue to consider alternative arrangements or adjustments that may need to be made on a case by case basis. Employers should also ensure that they carry out a specific risk assessment and helpful further guidance can be found on the Health and Safety Executive website and the Governments website offering guidance for women of childbearing age, currently pregnant or breastfeeding.

Question 2 Unemployment Eligibility Requirements

In Minnesota and many other states, individuals must demonstrate that they are out of work through no fault of their own to collect unemployment benefits. Although people who have lost their jobs or had their hours significantly reduced because of COVID-19 may generally qualify for unemployment benefits, states have yet to clarify whether this remains true when an employee is fired or has hours significantly reduced for refusing to get vaccinated. In June 2021, the Equal Employment Opportunity Commission updated its guidelines to address this exact concern.

EEOC guidelines provide that vaccine mandates are just like any other workplace safety guideline, and if an employee is fired for not following such a guideline they generally will be unable to collect unemployment, because they were fired for good cause. This would be akin to an employee refusing to submit to a permissible drug test or participate in safety training. However, employers must still adhere to federal employment non-discrimination laws, such as Title VII of the Civil Rights Act of 1964 and the Americans with Disabilities Act , and must provide reasonable accommodations for employees who, because of a disability or a sincerely held religious belief, practice, or observance, do not get vaccinated for COVID-19.

Can Employers Require Covid

Yes, employers retain the legal right to require COVID vaccines for their employees.

This means that your employer can, in fact, require you to take COVID-19 tests and be vaccinated before you can physically enter their workplace.

However, this vaccine mandate comes with certain rules and regulations.

  • The vaccine must be a business necessity. This means that your employer must be able to prove that unvaccinated employees pose a risk to and can harm the health and safety of themselves or others.
  • So, if your employer has issued a vaccine mandate, they have the right to fire you for breaching work policy, which is a cause. And getting fired for a cause means that you may not be eligible to claim unemployment benefits.

    In other words, you can lose your job for a vaccine mandate, and be ineligible for unemployment benefits.

    Lost Your Job For Not Getting Vaccinated You Still Probably Won’t Qualify For Unemployment

    But four states have new laws extending benefits to those who don’t comply with vaccine requirements.

    Vaccine requirements could make you ineligible for jobless aid if you don’t have a legitimate exemption.

    Employees who don’t comply with their company’s vaccine requirements will generally be ineligible to collect unemployment benefits, but that’s changing in a few states: Iowa, Tennessee, Florida and Kansas.

    As vaccination mandates continue to sweep across the US on both a federal and state level, so too have multiple legal challenges. Last month, the Fifth Circuit Court of Appeals blocked President Joe Biden’s far-reaching vaccine mandate for large private employers, causing the Department of Labor’s Occupational Safety and Health Administration to suspend the requirement pending further litigation. And this week, the national vaccine mandate for health care workers, which was set to begin Dec. 6, was halted after a federal judge issued a preliminary injunction.

    Though qualifying for unemployment after you’ve been fired or resigned from a job due to a vaccine mandate is still an evolving issue — and largely determined case by case — four Republican-led states have taken measures to extend benefits to employees who refuse the vaccine. Other states have an entirely different approach. For example, New York explicitly disqualifies health care workers from unemployment benefits if they quit or are terminated for not adhering to vaccination requirements.

    Qualify For An Exemption

    One other way to avoid vaccine mandates at work is to qualify for an exemption.

    There are two exemptions that allow you to keep working without getting vaccinated.

    The first

    You can avoid vaccine mandates at work on the basis of religious beliefs.

    To be exempted on the basis of religious belief as provided in Title VII of the Civil Rights Act of 1964, you have to belong to a religion that prohibits vaccines.

    You would also have to show that you are a longstanding member of the religion, and even provide written proof from a leader in said religion, explaining why you should not get vaccinated.

    However, keep in mind that you do not automatically qualify for a religious exemption. Rather, you only have a federally protected right to seek one.

    The second

    You can also avoid vaccine mandates at work on grounds of medical disabilities.

    Under the ADA and the Rehabilitation Act of 1973, employers have to consider reasonable accommodations for employees with disabilities.

    So, if you can prove that youre pregnant, or have a medical condition like severe allergy to any component of a COVID vaccine, or adverse reaction to a previous dose of the vaccine, you can apply for an exemption on the grounds of medical disability.

    The ADA and Title VII of the Civil Rights Act cover all employers, including those of state and local government employees.

    However, for disability accommodations, federal government employers have to comply with the Rehabilitation Act instead of the ADA.

    Whos Winning In Court

    Dozens of lawsuits have been filed against vaccine mandates from private employers, state and local governments, and the Biden administration.

    Private companies and state and local governments have largely prevailed in court, while federal measures continue to be locked in litigation, with two of the Biden mandates having been taken up by the U.S. Supreme Court.

    Private employers, especially, benefit from at-will employment, meaning they can generally fire employees for any reason so long as it doesnt violate the law or breach a contractual agreement.

    They also have a responsibility to keep their workers safe, and can argue that unvaccinated employees, including those seeking exemptions, can harm other workers or burden operations.

    Employees who were terminated from their job because of their refusal to get vaccinated for COVID-19 aren’t guaranteed to get their jobs back just because the Supreme Court struck down President Joe Biden‘s vaccine or testing mandate.

    The mandate, which required millions of employees to be vaccinated or undergo weekly testing, sparked questions about the legality of terminating employees over their vaccination status. However, in the majority of the United States, businesses can terminate employees for not complying with company policies and that doesn’t necessarily change because of the Supreme Court’s decision.

    Dorit Reiss, a University of California Hastings College of Law professor, told Newsweek that unless employees can claim religious discrimination or disability-based discrimination, employers are free to terminate employees for not being vaccinated. Employment in the United States is “at-will” so employers can implement whatever policies they want within the confines of the law and the default is that if employees don’t like the policy, they can find a new job.
