If an employer terminates you because you dont follow its policies, it has cause to fire you. And if youre fired for cause, you may be ineligible to claim unemployment benefits.

Every state defines for cause differently, Mariel Smith, partner at law firm Hall Booth Smith, PC. Most states have similar statutes that indicate if an employee is terminated for breaking company policy, the employee would be denied unemployment benefits.

In Texas, for example, you can be denied unemployment if you voluntarily resigned or are terminated for associated misconduct, says Carrie Hoffman, partner at law firm Foley & Lardner, LLP. Employers could argue that the refusal of the vaccine was a voluntary resignation or an involuntary termination for misconduct.

If your employers vaccination policy and ramifications are clear, its best not to expect any leeway if you get terminated and try to apply for unemployment.

I would caution employees against the notion that if they dont quit, but stay and get fired, they can get unemployment. Its very risky, Smith explains.

When it comes to the new federal mandate, its not as cut and dry, Smith says. Some states may choose to grant unemployment benefits to people who get fired for not getting vaccinated, especially in those states that have said theyll fight the federal mandate.

At this time, it’s unclear whether people will be able to decline the COVID vaccine because of their religious beliefs. Even within the clergy, some disagreement appears to have surfaced. For instance, Pope Francis is encouraging Catholics to get vaccinated, saying the Vatican approves of the various vaccines. Yet Archbishop for the Military Services Timothy Broglio says Catholic troops can refuse the COVID-19 vaccine if receiving it would violate their conscience.

New York has been back and forth on religious vaccine exemptions. Health care workers filed a lawsuit against the mandate, saying it violates their First Amendment rights and the Civil Rights Act. On Tuesday, a judge ruled that those health care workers can seek religious exemption requests from a statewide COVID-19 vaccine mandate.

New York Gov. Kathy Hochul, a Democrat, said she’d fight the judge’s decision, citing the public health crisis that COVID poses to New York state residents.

Some employers might impose fines on employees who choose not to get vaccinated.

Employees across the country are losing their jobs because they won’t get vaccinated against COVID-19, and receiving unemployment benefits depends on the reason the worker was let go and where the person is.

Federal, state and local governments have started implementing vaccine mandates for certain employees, bucking criticism of government overreach and calls for testing options. Individual businesses have also decided to require vaccines.

People who lose their job over a vaccine mandate are generally considered ineligible for unemployment benefits because they failed to comply with company policy, but there are exceptions. State departments of labor decide who should and shouldn’t receive unemployment benefits, and some officials are looking to compensate people who were fired because of a vaccine mandate.

Republican lawmakers in Pennsylvania, Tennessee and Wisconsin have introduced legislation that would allow employees who refuse a COVID-19 vaccine to receive unemployment benefits.

Employees in Texas also may be eligible for benefits, the Texas Workforce Commission wrote in a newsletter sent out at the beginning of the year.

The appeals court said the state’s labor department violated the nurse’s “freedom of expression” by refusing to pay her unemployment benefits.

Attempts To Change State Laws Have Largely Stalled

Legislators in several states have proposed making discrimination based on vaccine status illegal and guarantee access to unemployment benefits if a worker doesnt comply with their employers vaccination policy.

Tennessee saw one such bill introduced in its Senate in February 2021 to prevent discrimination based on vaccination status. The bill would also ensure access to unemployment benefits for unvaccinated people who decide to leave their jobs, but it has not yet been considered in committee.

In Idaho, a bill passed the House to prohibit discrimination based on vaccination status. It has not been taken up in the Senate, where it has sat since February.

A bill in Michigans House of Representatives would prohibit employers from discriminating against employees who dont get vaccinated. It was introduced in March, but not considered in committee.

In January 2021, Alaskas General Assembly introduced a bill to prohibit mandatory vaccination in the workplace. Arizona, sought to prohibit vaccination status as a condition of employment, but the proposal died in committee in .

Smith says its unlikely that any laws like this get passed to protect workers who dont want to get vaccinated.

If in fact those types of laws are passed, it is completely opposite of the basic fundamentals of labor and employment law, that if youre fired for cause, you cant get unemployment, she says.

Usually, there’s a one-week waiting period before you can begin receiving unemployment benefits, followed by an additional week or two before your first check arrives in the mail. Because unemployment offices across the nation are seeing historic numbers of applications, however, it may take longer to process your request.

Is There A Supplemental Payment

The $600 weekly supplement was in effect for weeks ending April 4 through July 25. This program was reinstated at a lower $300 weekly rate beginning December 27, 2020, and has been extended until September 6, 2021.

Additionally, two prior programs provided a supplemental payment for eligible claimants.

The Lost Wages Assistance program will provide an additional $300 per week for the weeks ending August 1 through September 5, 2020. To be eligible for the additional LWA supplement, you must:

  • Be receiving at least $100 per week in unemployment benefits from any other state or federal source and
  • You may need to self-certify that you are unemployed due to a COVID-related reason these reasons are listed under the PUA benefits description above.     If you are not working a full-time schedule of hours , you may be classified as partially unemployed, and you may be entitled to receive reduced benefits during any period in which you remain in partially unemployed.     If your earnings exceed 133% of your unadjusted weekly benefit, then you do not qualify for partial benefits, even if you are not working full time.

    If you have to care for your child during the work week because their school or day care has temporarily closed due to COVID-19, you can claim unemployment benefits. The same is true if you now find yourself responsible for an elderly parent or other household member whose care facility has been shut down.3

    Another option: if you work for a business with fewer than 500 employees, you might qualify for up to 12 weeks of paid family leaveat two-thirds of your normal pay, capped at $1,000 per weekif the coronavirus pandemic requires you to care for a child whose school or day care has closed.4

    You cant qualify for unemployment insurance and family leave at the same time, so your choice will depend on which benefit works best for you. However, if you take family leave and are still not able to go back to work after it runs out, you are then eligible for unemployment.5

    Have Your Information Ready To File

    Why wait? If you can get a COVID

    Even if you haven’t been laid off or had a dramatic reduction in your hours, now is the time to make sure you have copies of your most recent pay stubs, Evermore says. Make sure those are easily accessible because if the employer shuts down, it may be more difficult to get copies.

    When filling out your application for unemployment benefits in the state where you worked, the employment agency will need to verify your income. If the employer is no longer in business, you’re going to need your own records, Evermore says.

    I Was Furloughed By My Employer But They Have Now Reopened And Asked Me To Return To My Job Can I Remain On Unemployment

    No. As a general matter, individuals receiving regular unemployment compensation must act upon any referral to suitable employment and must accept any offer of suitable employment. Barring unusual circumstances, a request that a furloughed employee return to his or her job very likely constitutes an offer of suitable employment that the employee must accept.

    While eligibility for PUA does not turn on whether an individual is actively seeking work, it does require that the individual be unemployed, partially employed, or unable or unavailable to work due to certain circumstances that are a direct result of COVID-19 or the COVID-19 public health emergency. In the situation outlined here, an employee who had been furloughed because his or her employer has closed the place of employment would potentially be eligible for PUA while the employer remained closed, assuming the closure was a direct result of the COVID-19 public health emergency and other qualifying conditions are satisfied. However, as soon as the business reopens and the employee is recalled for work, as in the example above, eligibility for PUA would cease unless the individual could identify some other qualifying circumstance outlined in the CARES Act.
