Can employers require the COVID-19 vaccine and can they legally ask if you’ve been vaccinated?

Congresswoman Marjorie Taylor Greene, R-Georgia, a well-known vaccine critic and skeptic, was recently asked whether she’d been vaccinated against COVID-19.

She responded by saying that the question itself was “in violation of my HIPAA rights.”

By HIPAA, she was referring to the Health Insurance Portability and Accountability Act, the 1996 federal law that prevents people’s private health information from being shared by health care providers without patient consent.

“ith HIPAA rights, we don’t have to reveal our medical records,” Greene continued, “and that also involves our vaccine records.”

Her first claim, that asking questions about vaccination status is itself a violation of federal law, has been roundly dismissed as an absurdity. But the second part, about one’s obligations to reveal vaccination status, raises questions that are worth exploring.

No. Any organization can ask any employee, customer, or relevant third party whether or not they have been vaccinated against COVID-19 without violating HIPAA. However, before asking the question, organizations should be prepared for how they will respond to individuals´ answers, or how they will respond if an individual refuses to answer the question.

COLUMBUS, Ohio You might have seen a claim online that said your employer or your coworkers cannot ask you whether you’re vaccinated because of the HIPAA federal privacy law.

So we’re verifying, Is it a HIPAA violation for your employer to ask if you are vaccinated against COVID-19?

“The employer, the restaurants, your nail salon, your barber, they’re all able to ask if you’ve been vaccinated. They’re not covered by HIPAA. It’s not a violation and you don’t have to answer either,” Landes explains.

HIPAA only applies to specific health-related entities, such as insurance providers, doctors and hospitals.

Landes also said that if you’re applying for a job, you can be turned down based on your vaccination status.

“If the employer asks you if you’ve been vaccinated as part of the employment process and you say you’ve not been vaccinated, the employer can decide not to hire you on that basis. If they don’t know anything about you, your medical status or religious status, they can’t really discriminate on that basis because they don’t know about it,” Landes said.

Ocr Issues Clarifying Guidance On Hipaa Covid

Questions abound as to whether HIPAA comes into play when COVID-19 vaccination information is provided to employers. Recently, the U.S. Department of Health and Human Services Office for Civil Rights issued clarifying guidance on the applicability of the HIPAA Privacy Rule in the context of COVID-19 vaccination information provided to employers.

This guidance is to remind the public that the HIPAA Privacy Rule generally does not apply to employers or employment records, which includes health care providers in their roles as employers. The HIPAA Privacy Rule applies only to health care providers and health plans in their roles as health care providers or payers not in their roles as employers. The guidance emphasized that the HIPAA Privacy Rule does not prohibit anyone, including health care providers, health plans, and their business associates, from asking whether an individual has received any vaccine, including the COVID-19 vaccine.

Importantly, OCR clarified that in the current COVID-19 environment, a health care provider is permitted to disclose PHI relating to an individuals vaccination status to the individuals employer for purposes of surveillance of the spread of COVID-19 within the workforce, so long as all of the following conditions are met:

Requiring Proof of COVID

With COVID-19 vaccinations being the highlight of the healthcare news, and proof of vaccination being a requirement in many places, some are concerned about their right to privacy about their health.

Although an employer or a business can ask you about your COVID-19 vaccination status, you are free to refuse to provide that information. However, you are not free from the consequences of refusal.

It is important to remember that although restrictions are easing for fully vaccinated people in the US, businesses still have an obligation to keep the workplace safe. This means keeping both employees and customers healthy. It is important for them to have you follow their safety protocols in order to keep everyone safe.

This means that your employer can ask if you are experiencing COVID-19 symptoms, can take your temperature, and even ask for proof of a vaccine. They may also keep records regarding employee health, but the EEOC stresses the importance of keeping such information confidential.

Disclosing some information about your personal health may feel uncomfortable, but it is legal for employers and businesses to ask reasonable questions in order to maintain safe environments. However, this does not mean that you must share every detail about your personal health history.

Other Regulations That May Apply

Beyond COVID-19 and HIPAA, there is further guidance available from the Equal Employment Opportunity Commission and the Occupational Safety and Health Administration . Employers should review the guidance available to make sure they avoid discrimination, honor requests related to disabilities and maintain standards and records required under OSHA.

Employers should also follow relevant state and local laws that might apply to them.

When Youre An Employee

Similarly, thereâs no federal law that forbids your employer from asking your vaccine status. But they must keep your information confidential. Itâs up to you to decide whether you want to share that info with them. You might have to deal with job-related consequences if you don’t, though.

Federal equal opportunity laws also donât stop employers from requiring employees who work in-person to get vaccinated for COVID-19. But in some situations, employers must make accommodations for workers who canât get the vaccine for certain reasons, like a disability or strong religious belief. The exception is if those accommodations âwould pose an undue hardship” on operating the business.

If youâre unvaccinated and need to work at your place of business, your employer can ask you to do certain things that lower the chances of you or your co-workers catching COVID-19, such as:

  • Wear a face mask at work.
  • Stay socially distanced from others.
  • Work different hours.
  • Occasionally get tested for COVID-19.

Some employers might give you the chance to work from home or get reassigned to a different role.

You could be entitled to accommodations like these if youâre pregnant and thereâs also a medical reason you canât get vaccinated. In general, though, pregnant women can get the COVID-19 vaccine.

The HIPAA Privacy Rule limits uses and disclosures of individuals PHI to uses and disclosures required for treatment, payment, or healthcare operations. Other uses and disclosures generally require consent to be provided by the individual in writing. However, HIPAA only applies to certain organizations and businesses. So how does HIPAA relate to requests for proof of vaccine status?

Who Can Legally Ask Me About My Vaccination Status

Under federal laws, there are very few, if any, situations in which businesses, airlines, employers, schools and even those covered by HIPAA are prohibited from asking you to share your vaccination status or show your vaccine record card, experts said.

  • Recommendation: Employers should not make a copy of these records. Sure, have someone on HR look at it, note that it was shown, and let that be all. If employers insist on copying it anyway, black out everything on there that is irrelevant, such as DOB, medical record number, etc. Employers need to store these copies securely and retain them for the minimum time necessary.

If a business is not categorized as a covered entity as set out in the law, it’s not required to follow the HIPAA rules about patient privacy. There are of course other rules that businesses, employers and schools do need to follow that protect your privacy. Here’s a partial list of which organizations do not fall under HIPAA rules:

  • Life insurers
  • Most schools and school districts
  • Many state agencies such as child protective service agencies
  • Most law enforcement agencies

Businesses could ask for proof that you’ve been vaccinated.

    The U.S. Department of Health and Human Services has released guidance to address how the Health Insurance Portability and Accountability Act Privacy Rule applies to various entities requests for information related to an individuals COVID-19 vaccination status.

    HHS emphasized that the Privacy Rule applies only to covered entities, including health plans and most health care providers,and their business associates . The Privacy Rule does not apply to other individuals and entities.

    Covid Vaccine Information And Hipaa Compliance

    It is a common misconception that all health information, regardless of its source or who is asking for it, is subject to the privacy protections of HIPAA, the Health Insurance Portability and Accountability Act of 1996. Simply put, this isnt true. Some recent FAQs from the Department of Health and Human Services demonstrate how this applies in the current COVID context.

    HIPAAs Protections

    As the FAQs make clear, HIPAAs privacy rule only applies to covered entities and business associates. Covered entities are health plans, health care clearinghouses, and health care providers that conduct certain electronic transactions. Business associates are typically vendors who assist covered entities and have access to protected health information from the covered entity.

    Additionally, HIPAA does not typically govern asking for health information. However, once a covered entity or business associate has protected health information, HIPAAs privacy rule puts limits on the covered entitys or business associates ability to use or disclose the protected health information.

    Ask and You Can Receive

    Given this background, if a business or individual asks if you are vaccinated, is that a HIPAA violation? No, its not. For example, a restaurant is not a covered entity and almost certainly not a business associate, but even if it was, asking for the information is not a HIPAA violation. The same analysis applies to a school, entertainment venue, or retail store.
