Its already an up-close and personal experience that can be a little awkward. Now many find themselves with a tricky new question: are they entitled to quiz their doctor, dentist, fitness trainer, therapist or hairstylist whether theyve been vaccinated?

With information and official guidance fluctuating as the Delta variant of the coronavirus spreads swiftly across the US, largely driven by the unvaccinated, there is confusion about safety in certain places where people might remove their masks, such as healthcare facilities or spas.

The US Centers for Disease Control and Prevention recently changed its guidance on masking, advising that even vaccinated persons wear masks inside indoor public spaces in areas with substantial or high Covid-19 transmission.

And New York last Tuesday became the first major US city to announce it would soon require proof of Covid-19 vaccination not only for all city employees, but also for all members of the public who want to eat indoors at restaurants, view indoor performances or patronize the gym.

But the loaded question arises: whether and how the public should ask about vaccination in certain necessarily close-quarter settings.

You can always ask those things, it just depends on what kind of answer youre going to get, and whether you believe them, he told the Guardian.

Hipaa May Apply To Some Self

Some employers are self-insured. When it comes to the insured part of the company, these employers are covered entities under HIPAA because they are basically considered insurance providers. There are several ways to operate self-insured plans, such as using a third party to manage the benefits so that the employer is completely hands-off. The employer is fully self-insured and either does or does not have access to protected health information.

Self-insured employers should be aware of their responsibilities under HIPAA . But when it comes to COVID-19 screening, employers are not health care providers screening employees or visitors.

Employers must keep the information away from the insurance side of their activities, as well as from the personnel/HR activities. The COVID-19 screening should be its own activity with separate records.

What You Need To Know About Hipaa

First, the main goal of HIPAA is helping people maintain their healthcare insurance coverage if they change or lose their jobs. The Act encouraged the use of electronic records to transfer patient information. Remember, moving data around electronically wasnt widespread in 1996. Rules were soon added to respond to concerns about keeping our health information private.

However, the HIPAA privacy rules are rather limited: they prohibit the release of protected health information by others without your consent. They have nothing to do whether you can or should answer questions about your vaccination status, or any other health issue. Thats simply not what HIPAA does.

And to be clear, HIPAA defines protected health information as

  • health information that is “individually identifiable” that is, medical information that includes information that identifies you, such as your name, address, or date of birth
  • information about a physical or mental condition you have or had in the past
  • a description of healthcare you have received
  • details about payments made for healthcare youve received.

Heres what the privacy rule requires. Anyone who has access to your protected health information, such as healthcare providers, health insurers, or medical billing companies, must

  • make sure its kept confidential
  • defend health information against security threats
  • ensure that employees are trained in and diligent regarding the confidentiality of PHI.

    Misuse and misconceptions about HIPAA have been circulating in the news recently, with some falsely claiming the privacy law prohibits being asked about COVID-19 vaccination status, according to Robert Shmerling, MD.

    In an Aug. 19 op-ed for Harvard Health Publishing, Dr. Shmerling, senior faculty editor for Harvard Health Publishing and an associate medicine professor at Harvard Medical School, shared key facts about HIPAA and said the law is unrelated to vaccination disclosures.

    Seven things to know about HIPAA regarding vaccination status, according to Dr. Shmerling:

    1. Some fake mask exemption cards, which are available online and intended to let the owner forego wearing a mask for medical reasons, falsely claim that the card’s owner is not required to answer any questions about their medical condition. This is not true under HIPAA.

    2. HIPAA privacy rules prohibit the release of protected health information, known as PHI, by others without your consent and “they have nothing to do with whether you can or should answer questions about your vaccination status, or any other health issue,” Dr. Shmerling wrote.

    3. HIPAA defines PHI as health information that is “individually identifiable,” meaning it includes details that identify you, such as name, address and birth date information about physical or mental health conditions you have or have had previously details on healthcare you’ve received and information about payments made for your healthcare services.

    Can A Business Ask For Proof Of Vaccination

    Subject to state laws, businesses can ask for customers to demonstrate proof of vaccination, but due to laws such as ADA cannot flatly refuse to provide a service to the customer if they cannot prove their vaccination status. Instead, if a customer has not been vaccinated or refuses to disclose their vaccination status, businesses can require the customer to wear a mask or can organize an outside delivery of their purchase. If the customer refuses to agree to the compromise, businesses can then refuse to provide a service on health and safety grounds.

    Covered Entities And Business Associates As Employers

    Question: Does the HIPAA Privacy Rule prohibit a covered entity or business associate from requiring its workforce members to disclose to their employers or other parties whether the workforce members have received a COVID-19 vaccine?

    Answer: No. The Privacy Rule does not apply to employment records, including employment records held by covered entities and business associates acting in their capacity as employers.

    The guidance includes examples, note that the Privacy Rule does not prohibit a covered entity or business associate from requiring or requesting each workforce member to:

    • Provide documentation of their COVID-19 or flu vaccination to their current or prospective employer.
    • Sign a HIPAA for a covered health care provider to disclose the workforce members COVID-19 or varicella vaccination record to their employer.
    • Wear a mask while in the employers facility, on the employers property, or in the normal course of performing their duties at another location.
    • Disclose whether they have received a COVID-19 vaccine in response to queries from current or prospective patients.

    Question: Does the HIPAA Privacy Rule prohibit a doctors office from disclosing an individuals protected health information , including whether they have received a COVID-19 vaccine, to the individuals employer or other parties?

    The Health Insurance Portability and Accountability Act is a US federal law that created national standards to protect patient health information from being disclosed without that persons consent. This law only applies to certain organizations and businesses, called covered entities. Namely, healthcare providers and health insurance plans cant give out someones health information without their consent, except for treatment, payment, and healthcare operations. Other organizations, like businesses and employers, can ask about vaccination and require proof of vaccine status. If someone is not vaccinated, employers and businesses can require a person to follow safety measures to reduce the risk of spreading Covid-19, like masks or physical distancing. If that individual decides not to comply, businesses can refuse service based on health and safety concerns.

    The Equal Employment Opportunity Commission gave some advice to employers about this very issue. They said that it is totally ok to ask about vaccination status but should avoid asking why someone did not get vaccinated. There may be reasons someone chose not to get vaccinated that are disability-related, and this would butt up against the Americans with Disabilities Act .

    President Joe Biden invited CEOs and business leaders to the White House on Sept. 15, 2021, to discuss COVID-19 mandates.

    WASHINGTON – The U.S. Department of Health and Human Services’ Office for Civil Rights said on Thursday that the Health Insurance Portability and Accountability Act of 1996 Privacy Rule does not apply to employers or employment records.

    That means companies are not infringing upon their employees legal privacy by asking them to reveal their COVID-19 vaccination status.

    The OCR guidance aims to help “common workplace scenarios and answers questions about whether and how the HIPAA Privacy Rule applies. This information will be helpful to the public as we continue to navigate the COVID-19 pandemic,” according to an HHS news release.

    “We are issuing this guidance to help consumers, businesses, and health care entities understand when HIPAA applies to disclosures about COVID-19 vaccination status and to ensure that they have the information they need to make informed decisions about protecting themselves and others from COVID-19,” said OCR Director Lisa Pino.

    Some have argued that requiring workers to disclose their vaccination status goes against HIPAA, but that has been proven repeatedly to be false.
